Effect of amendments to the Civil Code on the real estate practice

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

1 LAND REGISTRY ABSTRACT The aim of this rigorous thesis was to provide a comprehensive overview of the current legal regulation in the field of Land Registry, which is primarily regulated by two legal regulations, the Cadastral Act No. 256/2013 Coll. and the Decree on Cadastre No. 357/2013 Coll. The first chapter deals with the theoretical concepts with which the Land Registry works. The author has defined and explained in detail the concept of Land Registry and its purpose. The second chapter deals with the history of the Land Registry, which dates back to Ancient Egypt. It describes in detail the historical development up to the current legislation. The third chapter deals with the principles that run through the entire Land Registry and on the basis of which the Land Registry acts. Among others, the principles of material and formal publicity, the principle of superficies solo cedit, intabulation, and disposition can be mentioned. The fourth chapter regulates the filings to the Land Registry, specifically the entry, the record and the note. It also describes the entry procedure and concludes by explaining what is meant by the term seal. Entry record in the Land Register

The diploma thesis deals with the entry record to the Land Register of the Czech Republic. The adoption of the Act no. 89/2012 Coll., Civil Code and the Act no. 256/2013 Coll., On the Land Register, caused extended changes in the real estate register and cadastral legislation. This changes had a significant influence on some legal concepts relevant for this field of law. The diploma thesis in divided into four parts. The first part is used for the acquisition of basic knowledge on the issue of Land Register, with emphasis on principals that control the operation of the Lend Registry and making entries in it. The second part provides a thorough analysis of the current form of the institute of entry record and registration procedure with regard to previous legislation. The third section is devoted to examining of the German legislation, registration of real estate with an emphasis on the Land Registry, cadastral principles and registration of rights in the Land Register. This diploma thesis deals with the land registry. The purpose of my thesis is to compare old and new legislation relates to Cadastre of Real Estate. The reason for my research is that the new legislation came up with signicifant changes. At the beggining of my thesis you can find introduction. Introduction presents aims of my thesis and also structure. The thesis is composed of seven chapters. Chapter one concentrates on history of land registry. This chapter is subdivided into five parts. In each part is described one of important historical periods related to real estate record. Chapter two examines relevant Czech legislation of cadastral law. The purchase agreement for the transfer of real property

The thesis The purchase agreement for the transfer of real property, deals with the legislation of the purchase contract, deposit management and change of ownership of real estate registration in a public register. It also deals with the activities of the land registration office, and especially the review process. Under legislation is pointed out in particular the changes that have occurred with the introduction of the New Civil Code, which touched the ownership rights to real estate. The practical part focuses on the analysis of the shortcomings and errors occurring in sales contracts, which are the cause of stopping or rejection of an application for registration of property rights in real estate. These issues are dealt with on the basis of agreements adopted by the Land Registry department Beroun both after the introduction of the New Civil Code, and before him, were compared to changes in the error rate contracts. The conclusion is devoted proposals for measures that could eliminate errors and improve the quality of purchase contracts and the overall process of transfer of ownership.
Changes in cadastral offices and their clients arising from the new Cadastral act

This diploma thesis deals with issues of entering data regarding the right of ownership and other real rights into the cadaster of real estates. Issues of the data entry are compared before and after the new cadastral law went into effect in year 2014. Theoretical part briefly summarizes historical development of evidence of real estates in the area of current Czech Republic. Both cadastral laws and other law regulations are characterized. Further, the process of data entry of real rights is described along with the changes introduced by the new cadastral law. Practical part presents data obtained at the cadastral office of Litoměřice. Data gathered in years 2013 and 2014 are compared including the changes for the office employees and their clients stemming from the new cadastral law. Recommendations that could lead to improvement of operations of the cadastral offices and greater satisfaction of clients are suggested based on the evaluated data.

The Cadastre of real estates and method of real estate labeling in the cadastre of real estates

This thesis entitled the Cadastre of real estates and method of real estate labeling in the cadastre of real estates deals with the cadastre of real estates (in English also called the land register) and registration of real estates into the cadastre of real estates. Each real estate is labeled by the designated authority, which is called the Cadastral Office or Cadastre Office. This thesis presents structured summary of the whole cadastre system, its functions and scope of its activity. Considerable part of the thesis is dedicated to comparison of two cadastral acts, effective Cadastral Act and New Cadastral Act which will probably become effective since January 1st 2014. Most of the thesis is based on current legislation, primarily Cadastral Act (Act No. 344/1992 Coll. on the Land Register of the Czech republic) and Act on Property and other Rights in Rem Registration with Real Estate Register (Act No. 265/1992 Coll. on Property and other Rights in Rem Registration with Real Estate Register).
